Ricky Gervais hosting? A Bret Michaels set back and Halle Berry goes to battle! Find that and more in today's Showbiz Top 5!

5. Believe it or not, the Hollywood Foreign Press has asked Ricky Gervais to come back and host again next year. Despite bruised egos and hurt feelings, they can't deny that Ricky brought in the ratings. But will he take the job for a third year in a row? He said this last time was literally going to be his last time hosting, but I guess that depends on how sweet they make the offer.

4. Bret Michaels suffered a little scare after surgery to repair a hole in his heart. On January 24, Bret underwent the surgery in Phoenix and four days later, his blood pressure plunged. Doctors say it wasn't because of the heart surgery, but because of dehydration and exhaustion. They think it might be related to his diabetes. But Bret is doing much better now as he continues to recuperate at home.

3. Halle Berry has dropped out of a movie to prepare for a child custody battle with her baby daddy, Gabriel Aubry. Halle was supposed to start filming her part in the movie "New Year's Eve" in NYC this week, but fighting for her daughter has to be her priority right now. Personally, I think she saw this as an opportunity to drop out of a stinkeroo movie. But she released a statement yesterday saying that she has "serious concerns for her daughter's well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her." Meantime, Gabriel has lawyered up in both the US and Canada in a bid to win custody of little Nahla. At first, he was only interested in protecting his rights and gaining joint custody, but now that Halle is acting all crazy and having some scary, emotional outbursts, he's now pursuing sole custody.

2. Demi Lovato checked out of rehab for "emotional and physical issues" last week, but she's is continuing on her journey to total health. She was seen yesterday entering A New Journey Eating Disorder Center in Santa Monica, and we're assuming it's for further counseling.

1. RadarOnline.com is reporting that Charlie Sheen's parents are so concerned that he's going to end up killing himself that they're talking about going to court to gain conservatorship. Even though Martin and Janet Sheen realize it's unlikely their petition would be granted, but they're grasping at whatever straws they can right now to save their son's life. Even though it was reported yesterday that Charlie had checked into rehab, he has not. Charlie refused to go and nobody can make him. So execs at CBS and Warner Bros. contacted an addiction expert they're going to send to Charlie's house and try to get him to rehab at home. Yeah, right... Martin knows his son's not going to go along with that. So now he and his wife are considering their legal options.
