Indio Downey, the 20-year-old son of actor Robert Downey, Jr, has been charged with felony possession of a controlled substance and a misdemeanor charge of possession of a smoking device. This stems from his June 29 arrest following a traffic stop when cops found cocaine and drug paraphernalia on his person, E! News reports.

Downey is scheduled to be arraigned at L.A. Superior Court Airport Courthouse.

If convicted, he faces a maximum sentence of three years and six months, but since he is a first-time offender, he has the option of a drug-diversion program.

Downey, Jr., himself a recovering addict, issued the following statement to E! News, which read, "Unfortunately there's a genetic component to addiction and Indio has likely inherited it. Also, there is a lot of family support and understanding, and we're all determined to rally behind him and help him become the man he's capable of being. We're grateful to the Sheriff's department for their intervention, and believe Indio can be another recovery success story instead of a cautionary tale."

Indio is the actor's son from his previous marriage to Deborah Falconer.
